1. Agreement and Acceptance of Terms

Please carefully and fully read these Terms of Service ("Terms") before using the Coffee Prophet application ("App").

By using the App, you:

2. What Coffee Prophet Is and What It Is NOT

2.1. Application Definition

Coffee Prophet ("App") is a mobile entertainment application that uses artificial intelligence (AI) to analyze photographs of coffee grounds and generate text "predictions" ("Predictions") based on visual patterns and user text questions.

Key characteristics:

• Platforms: iOS (Apple) and Android (Google)
• Model: Freemium (free + paid subscription)
• Functionality: Image analysis, text generation via OpenAI GPT-5.2
• Target audience: Users 4+ years
• Languages: Russian, Turkish, Ukrainian

2.2. What This Is DEFINITELY NOT

• ❌ CANNOT replace a doctor, therapist, or psychologist
• ❌ DOES NOT PROVIDE psychological or psychiatric help
• ❌ DOES NOT GIVE financial advice or investment recommendations
• ❌ DOES NOT GIVE legal recommendations or consultations
• ❌ IS NOT scientific research or a proven method
• ❌ CANNOT predict the future with any accuracy
• ❌ IS NOT BASED on any paranormal or supernatural phenomena

2.3. Nature of Predictions

Predictions are generated:

• By artificial intelligence (OpenAI GPT-5.2)
• Based on analysis of visual patterns in coffee grounds
• Using random elements and algorithms
• In a completely random manner

Predictions:

• 🎲 Have no scientific basis
• 🎲 Have no proven predictive value
• 🎲 Cannot be used for making important decisions
• 🎲 Are entertainment content

3. Age Restrictions and Consent

Minimum age of use: 4 years (per App Store / Google Play classification)

Recommended age: 13+ years

For Users Under 13

You can use the app, but with parental or guardian consent and supervision.

For Users 13-18 Years Old

You can use the app independently. For paid subscription, parental consent may be required in some jurisdictions.

For Users 18+

You can use the app fully without restrictions.

4. Acceptable Use Policy

By using the App, you agree NOT to:

Illegal Activity

• ❌ Commit fraud or blackmail
• ❌ Impersonate another person
• ❌ Infringe on others' intellectual property rights

Malicious Content

• ❌ Upload viruses, trojans, malware, or other malicious code

Offensive Content

• ❌ Upload obscene, pornographic, or violent content
• ❌ Post insults, threats, or hateful content
• ❌ Engage in harassment or bullying

Consequences of Violation

If you violate these rules, we may:

1. Send you a warning
2. Restrict your access
3. Block your account (temporary or permanent) without refund
4. Report to law enforcement (if the action violates law)

Canceling on iPhone (iOS):

1. Open the App Store app
2. Tap on your profile picture in the top right corner
3. Tap on "Subscriptions"
4. Find "Coffee Prophet" in the list
5. Tap on "Cancel Subscription"
6. Confirm cancellation

Canceling on Android:

1. Open the Google Play Store app
2. Tap on your profile picture in the top right corner
3. Tap on "Manage subscriptions"
4. Find "Coffee Prophet" in the list
5. Tap on "Cancel subscription"
6. Follow instructions

Timeline: Cancellation takes effect immediately, but you retain access until the end of the current period.

5.4. Refunds

Refunds are processed THROUGH Apple / Google, NOT through us!

Refund on iOS: Visit https://reportaproblem.apple.com/

Refund on Android: Google Play Store → Settings → Manage Subscriptions → Refund

Refunds we DO NOT give:

• ❌ Refund for used service
• ❌ Refund for lack of "prediction" (we guarantee functionality, not results)
• ❌ Refund for choosing to delete account
• ❌ Refund after 14 days (Apple) / 7 days (Google) from payment date

6. Intellectual Property

What We Own

Dinkel AI & MEDIA TECH GmbH owns:

• ✅ Application code (source code and compiled version)
• ✅ User interface design (UI)
• ✅ Graphics, icons, and "Coffee Prophet" logo
• ✅ Algorithms and machine learning models
• ✅ The name "Coffee Prophet"

What You Can Do

• ✅ Use the app for personal entertainment
• ✅ Share results with friends (screenshot of result)
• ✅ Tell about the app on social media

What You CANNOT Do

• ❌ Copy app code
• ❌ Modify or "hack" the app
• ❌ Distribute the app (except as a link to App Store / Google Play)
• ❌ Create derivative versions ("mod" of the app)
• ❌ Use the logo for commercial purposes

Your Rights to Uploaded Content

Photos you upload remain your property. We only use them to generate predictions.

Fortune results are generated by OpenAI GPT-5.2. You can use and share them as you wish.

7. Disclaimers and Limitation of Liability

What We DO NOT Guarantee

• ❌ That predictions will be accurate
• ❌ That predictions will come true
• ❌ That the app will work without errors
• ❌ That the app will be available 24/7
• ❌ That your data will NOT be lost

App Provided "AS IS"

The app is provided as it is. We provide NO warranties (express or implied). You use at your own risk.

Maximum Liability

Maximum $10 (or €9) or the cost of your subscription for the last 3 months, whichever is greater.

We are NOT liable for:

• ❌ Indirect loss (loss of profit, business)
• ❌ Incidental loss (data loss)
• ❌ Loss from incorrect prediction (this is entertainment!)
• ❌ Loss from service interruptions

8. Applicable Law and Dispute Resolution

These Terms are governed by Austrian Law + GDPR.

All disputes are resolved in Vienna, Austria courts.

Dispute Resolution Process

1. Step 1: Email us at support@sonaya.ai or partners@sonaya.ai. We will respond within 30 days.
2. Step 2: For EU users, alternative dispute resolution (ADR) is available via European ODR

9. Your Basic Rights

• ✅ You can cancel subscription at any time via App Store / Google Play (free, no penalties)
• ✅ You can delete your account at any time (Settings → Account → Delete Account)
• ✅ You can request a copy of all your data (Settings → Privacy → Download My Data)

11. Miscellaneous Provisions

Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement between you and us.

Changes to Terms

For critical changes, we will notify you via the app (popup) with 30 days for consideration.

For non-critical changes, we will simply update the document.

Severability

If any provision is found invalid, it will be removed, and remaining provisions remain in force.

Force Majeure

We are NOT liable for inability to perform due to natural disasters, war, pandemic, or other "Acts of God".

Language

Official language: English. In case of conflict with translated versions, the English version prevails.

If you are a consumer in the European Union:

• ✅ You use the app at your own risk
• ✅ Maximum our liability is $9 or subscription amount
